Article 1 – Definitions
-
Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
-
Consumer: the natural person who does not act for purposes relating to their trade, business, craft, or profession, and who enters into a distance contract with the entrepreneur;

Day: calendar day;

Continuing transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
-
Durable medium: any tool that enables the consumer or entrepreneur to store information personally addressed to them, in a way that allows future reference and unaltered reproduction;

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
-
Model form: the form included in the annex which the consumer can use to notify a withdrawal;

Entrepreneur: Sprinkle Labs, the natural or legal person who offers products and/or services to consumers at a distance;

Distance contract: an agreement concluded within the framework of a system for the distance sale of products or services organized by the entrepreneur, whereby, up to and including the conclusion of the agreement, exclusive use is made of one or more means of distance communication;

Means of distance communication: a tool that can be used for concluding an agreement, without the consumer and entrepreneur being in the same space at the same time.

Article 3 – Applicability
These general terms and conditions apply to every offer from Sprinkle Labs and to every distance contract concluded.
Article 4 – The Offer
The offer concerns the customization and purchase of drinking bottles and related accessories.
Article 5 – The Agreement
The agreement is concluded once the consumer confirms and pays for the order.
Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 14 calendar days without giving any reason.

This period begins the day after delivery of the product.

For multiple products ordered together but delivered separately, the period begins on the day the consumer receives the final product.

During the cooling-off period, the consumer shall handle the product and packaging with care. They shall only handle the product to the extent necessary to establish the nature, characteristics, and functioning of the product.

If the consumer exercises the right of withdrawal, they must notify Sprinkle Labs within the withdrawal period using the model form or by means of an unambiguous statement via email.

The consumer must return the products no later than 14 days after notifying of the withdrawal, in their original condition and packaging, as far as reasonably possible.

Upon withdrawal, the consumer will be reimbursed all payments, including standard delivery costs, within 14 days after notification of withdrawal. Sprinkle Labs may withhold reimbursement until the products are received back or the consumer proves they have sent them back.

If a bottle consists of multiple components (cap, body, loop, and base) and the body has been personalized, the right of withdrawal is excluded for the entire bottle. Only separately ordered, non-personalized parts fall under the right of withdrawal.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer, unless otherwise agreed.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:

Products made to the consumer’s specifications or clearly personalized (such as customized bottles, where a personalized body excludes the entire bottle from return);

Sealed products that, for health protection or hygiene reasons, are not suitable for return once the seal has been broken.
Article 9 – Prices and Promotions
All prices include VAT. Promotions apply while stocks last.
Article 10 – Conformity, Breakage & Warranty
Sprinkle Labs provides a 2-year manufacturing warranty. Damage upon delivery will be replaced free of charge.
Article 11 – Delivery, Transfer of Risk & Performance
Delivery within 30 days unless otherwise agreed. Risk transfers upon receipt.
Article 12 – Continuing Transactions
For subscriptions, statutory provisions regarding duration and termination apply.
Article 13 – Payment
Payment is made in advance via the offered payment methods.
Article 14 – Complaints Procedure
Complaints must be reported in writing within 7 days and will be handled within 14 days.
Article 15 – Disputes & Applicable Law
Only Belgian law applies. The Vienna Sales Convention is excluded.
Article 16 – Additional or Deviating Provisions
Any additional provisions may not be to the detriment of the consumer.
